Who is SmallClaims? +

SmallClaims ApS is a Danish company that helps both businesses and individuals conduct cases under the simplified court procedure in Denmark. We are registered as an authorized debt collection company with the Danish police (CVR: 43188739) and handle cases with a value of up to DKK 100,000.

Why should I take this inquiry seriously? +

We win 96% of all the cases we take to court. This means it is highly likely that the court will rule in our client's favour. You therefore risk having to pay both the principal claim and additional costs. We recommend paying immediately to avoid further consequences.

What happens when a case is filed with a court? +

When a case is filed with the court, the counterparty will typically first receive a writ of summons stating the claim and its grounds. As a rule, you have 7 days to acknowledge receipt and then 14 days to submit a statement of defence.

If you do not respond, the court can issue a so-called default judgment, ruling in our client's favour without further hearing.

If you do respond to the writ, the court may schedule an initial meeting — a so-called preparatory court hearing, which is often held digitally or by phone. Here the case and the next steps are discussed.

In some cases, further written exchanges may be needed, which can end in a physical court appearance at a so-called main hearing, where the parties present their case to a judge. This will always incur additional legal costs, payable by the party who loses the case.

What types of cases does SmallClaims conduct? +

As a rule, SmallClaims conducts all types of civil cases under the simplified procedure for claims up to DKK 100,000. SmallClaims also conducts cases at the enforcement court when required, and always requests attachment of the counterparty's and debtor's assets, which will be sold at a forced auction if the claim is not paid or an instalment agreement is not honoured.

Other payment options? +

In many cases it can be advantageous for the parties to reach a settlement — either before or during a court case. This is because legal costs typically increase the longer a case runs.

At SmallClaims we only take on cases that our legal experts assess to have a good chance of being won. We therefore recommend seeking a quick resolution through settlement, both to save time and to avoid unnecessary costs.

If you wish to enter into an instalment plan, you can request one. Requests are assessed individually from case to case, and not all requests can be accommodated.

Which court will hear the case? +

Civil small claims are heard by the district court with proper venue. The rules on venue are set out in the Danish Administration of Justice Act. Most often, the case is heard by the district court closest to the defendant's address. The same applies to cases at the enforcement court.
